The Schiavo case moves to the Supreme Court as a panel of the Eleventh Circuit Court in Atlanta denied the appeal to have the feeding tube reinserted. The Supreme Court has chosen to pass this case up twice before, so one question for the court will be whether it believes that Tom DeLay has the power to force them to do Congress' will.
U.S. House Majority Leader Tom DeLay, a Texas Republican, said in a statement yesterday that refusing to order reinsertion of the feeding tube while the case is studied further is "at odds with both the clear intent of Congress and the constitutional rights of a helpless young woman."
Not all conservatives are happy with the actions of Bush and the Congress, believing that there are Constitutional questions in this case and those concern the separation of powers.
