Signing Statements: When's The Court Challenge?

Now that the GAO has established that Bush's signing statements are being used by executive branch departments to blow off Congress, when will the Democratic leadership formally sue the Bush Administration to force a constitutional challenge in front of the Supremes? And can they please do it well in advance of the 2008 election to get the 2008 GOP candidates on the record in full support of this defiance of the legislative branch?
