Domestic Spying Lawsuit Against AT&T Moves Forward

Notwithstanding the victory that cowering, Blue Dog Democrats handed Bush last week on his domestic spying program, the Ninth Circuit just allowed a lawsuit to proceed against AT&T for letting the Bush Administration tap its phone and data switches without court orders. The court rejected arguments by both the company and the Bush Administration that litigating the case would violate national security, because Bush has already admitted he authorized electronic surveillance in violation of FISA, and is allowing the lawsuit to proceed.

The court specifically rejected the “Bush as King” inference behind the government’s position. The only thing stopping this case from going to trial now would be the Supremes overruling the Ninth Circuit by validating that Bush is King, thereby rendering the Constitution moot and the separation of powers dead.
