The Republic was lost a century and a half ago. You can't seriously tell me you believe that there has been a single Congress for over 100 years that has followed the most important clause in the Bill of Rights...
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
Think about all the garbage that both parties have passed as federal legislation that is not delegated to the United States. I'm still looking for the clause that would even remotely legitimize the Department of Education or the Department of Energy. I guess you could run to the "general welfare" clause, but don't forget that if you read it that widely you have to include corporate welfare.

Posted by Turkana at January 4, 2008 04:54 PMGreat post, Turkana.
I've thought that habeas corpus is so important because it requires accountability on those in charge. Bush's tossing it aside (and we Americans not rising up in protest) is a sign of how despotic our government has become. For one who has long loved the very ideals of this country since I was a child, it is a point of sadness and shame that we have come to this.
