The person having the greatest number of votes as Vice-President, shall be the Vice-President, if such number be a majority of the whole number of Electors appointed, and if no person have a majority, then from the two highest numbers on the list, the Senate shall choose the Vice-President; a quorum for the purpose shall consist of two-thirds of the whole number of Senators, and a majority of the whole number shall be necessary to a choice. But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.
The Senate can only make Biden, not Obama, vice-president.

It appears that under the 25th Amendment, Biden could appoint Obama VP upon becoming president, then upon Senate confirmation then resign and in turn be appointed by Obama as VP. Regardless, the tie almost certainly goes to the Democrats this year.

Phid: On Larry King tonite, some gop panelist (tax accountant) said we should change an accounting rule (no "mark to market requirement")and the problem would go away...she' basically implying that these near bankrupt institutions could simply change their asset value to book value (how much they paid for it) from the mark to market price(the "bid")which may or may not exist...is this a possible GOP soon to come talking point, to magically make the short term MARGIN requirements go away?? I wonder!!
