Earlier this week, NPR reported that someone at the Library of Congress (?) said that the nuclear option doesn't exist -- that the GOP doesn't have the power to change the rules unilaterally, with 50 plus 1 votes.
As I recall, the Constitution says the Senate shall make it's own rules -- and I'm damn sure the Senate didn't include this. Now, the GOP may be extrapolating the duties of the Sargent at Arms (or whoever) to justify this power grab -- but if they succeed, look for a suit before the Supreme Court to smack them down.

The SUPREME COURT does not have jurisdiction over this issue. Teh SENATE is a SEPARATE and EQUAL BRANCH of government. The SUPREME COURT cannot alter a RULE change in teh LEGISLATIVE BRANCH.
Also, precendence states that the SUPREME COURT will NOT get involved with a political issuein an INDEPENDENT and COEQUAL Branch of government.
I know this is dissapointing for PESSIMIST (the thought police) and the rest of the "RADICAL LEFT" who inhabit this blog since you depend on the judicial branch enacting policy that the rest of the country doesn't support.
This is why the CONSTITUTIONAL OPTION is necessary by FRIST. It will make the RADICAL LEFT have public support and not imposed by liberal judges who believe the CONSTITUTION means whatever that particular JUDGE feels like ift should mean!!!
The only thing that disappoints me, roofus, is that your spelling is as atrocious as your misunderstanding of the US Constitution. And, please remember to take your meds before you come out to play.

That was before Bush v. Gore. Therefore your example does not apply Dumbditto.
