I'm kind of rooting for the Republicans to attempt to break the deal first, since I'm not all that happy with it (after letting Owens though, the standard for "extraordinary circumstances" is now so high that the "nuclear option" might as well have been passed).

Now, the standard for service as a judge in this nation has been brought down so low that any amateur can take up the job!

Owen certainly can be shown to be unqualified to be a law clerk much less a judge! Take a gander at the opinion of her peers as to her qualifications:

With 350 responses, the Houston Bar Association Judicial Evaluation Poll rated Priscilla R. Owen Outstanding 39.5% (138 responses), Acceptable 15.2% (53 responses), Poor 45.3% (158 responses).

And that deal is that Scalia gets the Chief Justiceship and a right-moderate gets the associate seat. Without a lot of bullshit from the Left.

Reid can say that Thomas is a dope all he wants, but no one can say that of Scalia. The Supreme Court nominations will go smoothly for the President. I guarantee it.

That will happen Toby because it will not affect the ideological balance of the current court. If a center-left vacancy comes up and Bush nominates anyone who would change the balance of the court, we will be back to this point again and the nuclear option will get another chance to see the light of day, as it should.

Aside from the GOPDEM Lieberman, which of them do you think believes that the Bush/Rove Congress is actually interested in bi-partisan resolutions? I personally can't see how any of them cannot see through the Bush manipulations by now. Do you think they are that dumb? Could they be as dumb as Bush?

Yeah, I think that Joe Lieberman still thinks they can be trusted, and probably to a lesser degree Nelson does. Landrieu knows better, but votes gender and local politics above party all the time.

In a floor speech yesterday, Lindsey Graham hinted that Brown would not be confirmed. Can't remember his exact words, but he specifically mentioned Owen and Pryor (?) would be confirmed and didn't mention Brown. At least that was what I got out of it.

Since Brown is nominated for the DC court, which as I understand it, is second only to the Supremes, it's probably more important to keep her off that court (if one of the three is to be rejected).

Frist did his usual spinning yesterday, saying that Owen would be confirmed with broad bipartisan support. Ooooo-kaaaaay... two Dems voted for, one against. Fristy has a weird idea of what broad bipartisan support means, I guess.

Frist and Graham also nixed the idea that the deal means the nuclear option is off the table. The Rethugs can't be trusted!!!

I'm talking realism not cynicism Toby. The moment the GOP goes back on its deal and then tries to eliminate the filibuster for a Supreme Court nominee, the Dems win the 2006 midterms. I'll bet you a sixpack on that right now.

I've wondered if Brown wasn't the one that was going to lose on an up-or-down vote, and of the three she's poised to do the most damaging on the DC court. If they managed to keep her off of that alone is a good day's work.
