Prop 90 would be really bad. Seen a poll indicating 55 to 45 support for it. You west coasters better get those calls going. This one needs to be defeated.

This IS something we can both agree to. The Kelo verdict needs better law, and this ones not it.

I'm still disgusted that nuanced message of what a disaster this is to Oregon's progressive land use laws. I think that since Oregon's land use laws are so progressive and successful at helping the community at large...is part of the reason it passed.
A lot of conservative voters here can't seem to see past direct cause and effect. They are either willfully ignorant or simply too dumb to see the ancillary effects of stupid laws like this.
Our society, as a whole, has become so individualistic, that we fail to see how we need to support the community at large.

Posted by peter at November 5, 2006 07:13 PMWhen you're studying Con Law for the bar exam, one of the truisms is that regulation that diminishes the economic gains one could reap from property are not takings. Prop 90 would, in effect, undo that understanding.
It's a really bad idea. No matter what one thinks of Kelo, this law is not a well-reasoned approach to the concerns that case raised.

I've seen squat from the pro-90 side. That and Arnie's late rejection may put enough doubt in most voters heads that they do the usual thing to ballot measures that may cause harm but they arent quite sure of: They Vote No.
Here's hoping anyway.
