For the lawyers out there, a question:
Assuming Wells goes for an appeal, it will be to a 3 judge panel. How are the judges selected and from where do they come? My question is really: what is the liklihood that Scalito-prone judges will be out there to grant an appeal, prolong the agony, give Bush the capacity to keep saying "no comment, the case is ongoing"?

And what would the effect of a granting an appeal have on ongoing Congressional investigations?

Well, Scootsie has an absolute right to an appeal, that can't be denied in our system, even under Nero jr! (sarcasm) Our federal appellate judges don't decide whether they will hear an appeal from the district court---an appeal is "of right".

The Supreme Court has the discretion not to hear a case, but not the US Court of Appeals, which is the federal appellate court below the supreme court.

How appellate panels are chosen in each US "circuit" court varies. It's generally supposed to be random, but maybe an attorney who practices in the US Court of Appeals for the DC Circuit (where this appeal is going) can tell us their particular procedure.

The DC Circuit is extremely conservative, with many Bush appointees. But Wells has a very, very tough row to hoe here, IMO.

I can't imagine Nero will ever comment on the case--he doesn't want to!

BTW the trial judge, Judge Reggie Walton, is a George Bush appointee.

totally agree. bury those f...rs under an avalanche of subpoenas and put everyone of them away if I should say when they lie under oath. man this could be fun!!

I realy do think congress should start revving up for impeachment hearings. there hasn't been this much real criminal material meaing high crimes going all the way to the top since i was a near-youngster and nixon was hanged out to dry. but this time it's the boy emperor and the vicious analhoarding vindictive VP.
let the fun begin!!
