So Much For GOP Arguments For Tort Reform

The next time you hear Bush or any GOP slug tell you that tort reform is needed in this country to curb the out of control costs of class action litigation and excessive trial lawyer fees, remember that there is no conclusive proof of this. And a recently completed study has found that there has been no such explosion in either class action settlements nor trial lawyer fees from a reading of available case law, and that such costs have been stable for a decade now. Although most of these settlements occur at the state court level, and those records are the hardest to get, it also means that the insurance industry and corporations have no way to discredit these findings or back up their own claims with real data from the state courts.
